Terms & Conditions
§ 1 Scope
These General Terms and Conditions (hereinafter “GTC”) apply to all business relationships between The Geek Cat (hereinafter “Seller”) and the customer (hereinafter “Customer”) in the version valid at the time of the order.
Deviating conditions of the Customer are not recognized unless the Seller expressly agrees to their validity in writing.
§ 2 Conclusion of Contract
The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order.
By clicking the “Place Order” button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order is sent immediately after submitting the order by email. This order confirmation constitutes the acceptance of your offer.
§ 3 Prices and Payment Terms
All prices include the statutory value-added tax at the current rate of 19% and other price components.
Payment can be made by credit card, SEPA direct debit, PayPal, or purchase on invoice. For purchases on invoice, the payment term is 14 days.
§ 4 Delivery
Delivery within Germany is free of charge for orders over €50. For orders under €50, shipping costs of €4.95 apply.
The delivery time is usually 3–5 business days within Germany. For deliveries to other EU countries, the delivery time is 5–10 business days.
§ 5 Retention of Title
The goods remain the property of the Seller until full payment has been made.
§ 6 Warranty
The statutory warranty rights apply. The warranty period is two years from receipt of the goods.
§ 7 Liability
The Seller is liable without limitation for intent and gross negligence. For slight negligence, the Seller is only liable in case of breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage.

§ 9 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the Customer is a merchant, a legal entity under public law, or a public-law special fund, the exclusive place of jurisdiction is Berlin.
Should individual provisions of this contract be or become invalid, the validity of the remaining provisions shall not be affected.
